The monetary limit for Small Claims Courts will increase from R20 000 to R30 000 from 1 August 2026. The Department of Justice says the increase will allow more South Africans to resolve civil disputes quickly, fairly and at a lower cost without needing legal representation.
The department says the change will improve access to justice by enabling more people to take matters such as unpaid debts, faulty goods and service disputes to Small Claims Courts. The increase is the first since 2019 and forms part of government’s efforts to make the justice system more accessible and affordable.
