CAPE TOWN – An urgent legal opinion obtained by Parliament’s Impeachment Committee advises that the committee should oppose a court application linked to the Phala Phala Constitutional Court judgment. However, it stresses that the committee must continue acting independently and remain impartial while dealing with the matter.

The opinion further states that even if the committee decides not to oppose the application, it should still submit an explanatory affidavit to assist the court ahead of the July hearing. It also confirms that the committee is constitutionally required to comply with the Constitutional Court order that referred the Ngcobo Report to it for consideration and possible action.
