Pretoria- A legal challenge to overturn Advocate Andy Mothibi’s appointment as National Director of Public Prosecutions (NDPP) has been dismissed by the Gauteng High Court in Pretoria. The challenge, filed by Barnabas Xulu, argued that the advisory panel used to select NDPP candidates was unconstitutional and that Mothibi was not interviewed.

The court ruled that Xulu lacked legal standing and that his arguments confused consistency with rationality. As a result, Mothibi’s appointment remains valid and the bid to nullify it has been rejected.
